Brazil and FC Barcelona superstar, Neymar, could face a 2 years prison sentence for the fraud practices in his transfer to Barcelona from Santos in 2014.
The Spanish prosecutors recommended that the Brazilian will also be fined with $10m alongwith the 2 years sentence.
The prosecutors are so asking for a 5 years sentence for former Barcelona President, Sandro Russel who already had resigned from the club over the same issue. The prosecutors want to charge him over fraud and corruption.
The investment company, DIS, that owned Neymar’s 40% of sporting rights at the time of his transfer in 2013 had initiated the case.
While presenting their case on 23rd of November, DIS called for five-year sentences for the Brazilian and his parents, eight years for former Barcelona director Android Rosell and current Barcelona director Joseph Bartomeu and a mammoth 195 million euro fine on the Spainsh club.
If Neymar is handed a prison sentence of 2 years then according to Spanish law where a case for a person with no criminal case earlier in his life and been sentenced of a 2 years prison time can get away without serving judicial time. Although, DIS has asked that Neymar should not be allowed to play football during the sentence time.
Barcelona during the time of the Neymar’s transfer revealed the cost of the move at 57.1 million euros, 17.1 million of which was paid to his former club, Santos with the remaining 40 million paid to N&N, a company owned by Neymar’s family.
But, the Spanish authorities later believed that the real cost of the Brazilian’s move to Spanish giants was 83.3 million euros.
DIS received €6.8m, 40 percent of the fee paid to Santos.
The case was filed by DIS against Neymar, his family and Barcelona because the Brazilian investment company believes thaay they were cheated of its real share because part of the transfer fee was shared by Barcelona, Santos and the Neymar family.
Also, DIS has put forward that there was a pre-contract agreement between Neymar and Barcelona which was signed back in 2011 and it impeded other clubs from making offers for the player which affected the value of the transfer fee paid for Neymar.
Barcelona have faced another major dent to their image after the corruption case already on them and with other Barcelona stars like Messi, Mascherano and Alves facing the tax fraud allegations.
