Neymar’s never ending transfer controversy

Neymar, one of the best young players of the generation has been caught in another legal roadblock. The player had filed for the dropping of corruption charges levied. They Spanish High Court has rejected the appeal. Therefore, it implies that the player along with associates will have to stand trial on the charges of corruption. The case has been brought to the court by DIS Esporte, a Brazilian investment group.

Earlier, the judge had dropped charges against the player which DIS appealed against in the higher court. The judgment of the Court is final and cannot be appealed against. Therefore, Neymar could soon be looking to face trial and risk being sentenced to prison.

The parties involved:

The case is too complicated and it all stems from Neymar’s transfer in 2013. One of the most sought after players, Neymar decided to join Barcelona. The bone of contention was the complicated model of ownership of rights regarding the same. It all started when DIS, the party to the dispute paid Santos to get a 40% economic ownership over any transfer of the Brazilian. The complexity arose once the companies N&N Consultoria Esportiva and Empresarial Ltd got involved. Both these companies are owned by Neymar’s parents, Neymar da Silva Santos Sr. and Nadine Goncalves.

Hence, the player himself is being charged along with the club and the companies owned by his parents. The entire deal included too many middlemen and entities, thereby worsening the clarity of the case.

The obscure aspects of the deal:

Neymar has cost €57.1 million, full stop,” Rosell, the Barcelona President(2010-2014)

To begin with, the single most thing the world is not sure about is the actual transfer fees of the young Brazilian. While Barcelona has stuck to the figure of 57.1 million Euros, the total amount invested adds up to €86.2 million. It can be broken down as:

57.1 million euro for the transfer itself (of which 40 million euro went to the player’s parents), 10 million euro in the form of a signing-on fee, 2.7 million euro in commission, 4 million euro in marketing, 2.5 million euro for Neymar’s foundation and 9.9 million euro in scouting and collaborative deals with Santos. Therefore, DIS claims that the actual “transfer” fee was more than 17 million hold some credit. As of now, the company has received 6.8 million as a 40% part of the 17 million transfer fee.

We had better offers. I do not want this to generate confusion. He could have left for free in 2014, and I would have made €120 million, because there were offers from other clubs of this value. I repeat that I owe nothing to the taxman, not in Brazil nor in Spain—absolutely nothing.” – Neymar Sr.

Neymar’s father has been a primary player in the entire deal. Many have blamed him for being greedy and interfering in the deal too much. DIS believes that they deserve more than the amount they have received. The entire conflict revolves around the €40 millions paid to Neymar’s parents’ companies. In 2015, as per a Bloomberg report citing Epoca Magazine, “auditors requested an explanation for “atypical” cash flow of 115 million reals ($36.4 million) between 2011 and 2014 to a company set up by his (Neymar’s) parents.”

The new President has been firm about the 57 million transfer fees.

In 2016, the club admitted that the 40 million were a part of advanced wage and not a transfer fee. Therefore the club had to pay an additional 9.3 million in income taxes. Therefore, the deal has been subject to a lot of scrutiny and corruption. The club renewed Neymar’s contract after they thought the corruption case is past them. Until DIS turned up to file a case against them.

Possible outcomes:

There are high chances that the authorities will convict Neymar in this case. He could potentially face a two-year prison sentence like Messi. Though, he probably won’t be sent to the jail as sentences under 2 years can be served by paying off a fine. The set of allegations and court dates can also potentially affect his game, therefore the Barca administration should try to get rid of the legal troubles.
